Lots of Nothing

After much soul-searching, Tessa and I have decided to plead guilty to willful failure to file. 

April fools! (Sorry, couldn't resist.) Actually, we just got a disk of "discovery" materials from the DOJ (two weeks after requesting it), and the cover letter mentioned (as they probably always do) that "the government is willing to discuss a possible pretrial disposition of this matter involving a guilty plea to 26 U.S.C. 7203 and acceptance of responsibility." Yeah, sure. Right after hell freezes over. (We do "accept responsibility" for telling the TRUTH, even when the government didn't want us to.) 

The discovery materials, as expected, look to be lots and lots and lots of nothing, just like the "affidavit of probable cause." I guess including a LOT of substance-free and irrelevant nothing looks better than just having a little bit. It includes ALL of the www.taxableincome.net and www.theft-by-deception.com web sites, various irrelevant e-mails, lots of documents about the income that we admit to having received, etc. If I find anything interesting when going through it carefully, I'll let you know. 

A pretrial hearing is scheduled for next Wednesday afternoon (April 6th). Our notice of it didn't say exactly what it will be about. Our older motion to quash the search warrant (for the raid on 5/6/03) evolved into a motion to suppress. The government didn't file a motion in opposition, so we'll have to see what happens on that. 

We also haven't heard back on our motion for continuance yet. With three weeks until trial (as currently scheduled), and many hundreds of pages of documents to go through, I'm hoping to hear about it soon. When I hear, you'll hear. 

By the way, I just heard that Art Farnsworth's trial has been postponed until mid June. I was just about to tell you all where and when it would happen, when I heard it had changed. June could be an interesting month, with Joe Banister's trial, Art Farnsworth's trial, and Tessa and my trial 
(assuming we get the continuance) possibly all falling in that one month. I'll keep you updated.
